Notice of Public Hearing
In accordance with provisions of M.G.L Ch. 41, Sect. 81-T and the Town of Concord Subdivision Rules and Regulations, the Planning Board will hold a public hearing on the application of Mark Friedell for Barnes Hill Road LLC for a two lot Definitive Subdivision of land on land located at 150 Barnes Hill Road (Parcel 1341).
Concurrently, in accordance with M.G.L. Ch. 40A, Sections 9 & 11 and Sections 5.3.18 and 11.6 of the Concord Zoning Bylaw, the Planning Board will hold a public hearing to consider the Common Driveway Special Permit application of Mark Friedell for Barnes Hill Road LLC to allow the construction of a common driveway to serve two house lots within a Definitive Subdivision on land located at 150 Barnes Hill Road (Parcel 1341).
The public hearing is scheduled for Tuesday, June 18, 2013 at 7:00 p.m. in the First Floor Meeting Room, 141 Keyes Road, Concord, MA. A copy of the records, including the Definitive Subdivision plan, is available for review in the Planning Division Office at 141 Keyes Road weekdays between 8:30 a.m. and 4:30 p.m.

Site Plan Approval
On Tuesday, June 18, 2013 at 7:30 p.m. in the First Floor Meeting Room at 141 Keyes Road, Concord, MA, the Planning Board will hold a regular meeting pursuant to its review procedures under Zoning Bylaw Sections 7.9 and 11.8 to consider the application of Kearsarge Concord, LLC to allow the construction of a solar photovoltaic (PV) facility on the closed municipal landfill located at 755 Walden Street, Parcel 4039.
The plan and supporting materials may be reviewed at the Department of Planning and Land Management, Planning Division Office, 141 Keyes Road, weekdays between 8:30 a.m. and 4:30 p.m.

Planning Board Charge
The Planning Board consists of seven members, appointed for five-year, staggered terms by the Selectmen. By reason of Chapter 40A, all decisions as special permit granting authority shall require a two-thirds vote.
It shall be the duty of the Planning Board to investigate all petitions calling for a variation, modification, change, or extension of use under the Zoning Bylaw and to report its recommendations thereon to the Board of Appeals.
It shall be the duty of the Planning Board to conduct investigations respecting proposed amendments to the Zoning Bylaw appearing in the Warrant for any Town Meeting, and to present its recommendations to the Town for consideration at such Town Meeting. The Board of Selectmen shall cause the Planning Board to be notified of all such proposed amendments.
Subdivision Rules and Regulations set forth the Planning Board's procedures and standards to be followed in the subdivision of land and the construction of ways. The Concord Planning Board is authorized under the General Laws of Massachusetts to regulate the laying out and construction of ways in subdivisions to insure the safety, convenience and welfare of present and future inhabitants of Concord. The Board shall exercise its authority with due regard for the provision of adequate access to all of the lots in a subdivision by ways that will be safe and convenient for travel; for lessening congestion in such ways and in the adjacent public ways; for reducing danger to life and limb in the operation of motor vehicles; for securing safety in the case of fire, flood, panic and other emergencies; for insuring compliance with applicable
provisions of the Concord Zoning Bylaw and the Wetlands Protection Act; for securing adequate provision for water, sewerage, drainage, underground utility service, police and fire protection and other requirements where necessary in a subdivision; for coordinating the ways in a subdivision with each other and with the public ways in neighboring subdivisions; and for preserving the special historical and rural character of Concord.
