Pursuant to Section 9E of the Town Charter, the following policy is hereby promulgated by the Town Manager to govern the use of the sidewalks in the Town's commercial areas for the display of merchandise by merchants. The administration and enforcement responsibility for this policy lies with the Police Department. Such utilization of sidewalks is also subject to the provisions of zoning by-law
1. Merchandise shall only be displayed between April 1 and November 1.
2. Merchandise shall be displayed in front of the place of business, against the buildings only, and not along the curb.
3. Tables and racks used shall not exceed 24" in width and shall not protrude on the sidewalk in such a way as to obstruct pedestrian traffic.
4. All tables and racks shall be free of sharp corners, protrusions and devices which could inadvertently cause injury. Particular care shall be given to covers or markings to protect small children from bumping into merchandise displays.
5. Liability insurance coverage shall be carried, and evidence of same may be requested by the Town from any merchant displaying merchandise on the sidewalks or outside of doorways. Said insurance must cover personal injuries or property damage which may occur in such areas.
6. In response to specific safety concerns, the Police Department may prohibit sidewalk displays in designated areas during holiday parades or other specified times or days when sidewalk congestion is excessive.
7. The times for display shall be only during ordinary business hours of each participating merchant providing that any evening displays shall be properly lighted for safety and visibility.
